Wrongfully Imprisoned for 26 Days Over Alleged Fake Medical Report in Kishoreganj

A businessman named Nazrul Islam was incarcerated for 26 days in Kishoreganj under a court order, stemming from an attempted murder case. He alleges that the plaintiff submitted a forged CT scan report to the court, which was used to obtain a medical certificate from the Kishoreganj General Hospital falsely claiming a severe injury. This allegedly fraudulent certificate led to his imprisonment.

Filing Complaints and Initiation of Inquiry

On Thursday, Nazrul Islam filed a written complaint with the Health Secretary, demanding action against the members of the concerned medical board at the Kishoreganj General Hospital. On the same day, he filed a separate written complaint against the Investigating Officer of the case with the Superintendent of Police (SP).

Earlier on Wednesday, the victim filed a complaint with the Civil Surgeon of Kishoreganj, requesting an inquiry into the medical certificate. In response to his complaint, the Hospital Superintendent has been instructed to form a three-member committee to investigate the incident and submit a report within seven working days.

The Sequence of Events

Nazrul Islam, a resident of Uttar Kandail Kukimadol village in Karimganj Upazila, was sent to jail on May 28th after his bail application was rejected by Senior Judicial Magistrate Ariful Islam. He was released on bail on June 23rd, after serving 26 days.

The Alleged Forgery

Investigation reveals a discrepancy in the medical certificates:

1. Initial Certificate (April 24): Upon requisition by the Investigating Officer, Medical Board member Dr. Dilruba Sultana Shobha issued a certificate stating the injury was “simple.”

2. Revised Certificate (April 25): The patient’s relatives submitted a second report, a CT scan from Mediscan Specialized Imaging Center. Based on this new report, the Medical Board issued a revised certificate classifying the injury as “severe,” which was then presented in court by the plaintiff.

Nazrul Islam alleges that this revised certificate was issued based on a forged report. He pointed out that the CT scan report itself wrongly stated the patient’s gender as ‘female’ despite the patient being a male.

Responses from Concerned Parties

• Nazrul’s Wife, Rokeya Akter: “We did not get justice for the kidnapping of our child and the attack on my husband; instead, my husband was jailed based on a fake CT scan report. The police also submitted the charge sheet without verification.”

• Plaintiff’s Brother (Mokarram): When contacted, Emdadul Haque’s brother, Mokarram, said, “They (the accused) can claim the certificate is fake. The doctor provided the certificate; whether it is fake or correct, the doctor can say. And it is the Judge’s responsibility to look into the matter.”

• RMO Debashish Bhowmik (Medical Board Member): “We had suspected the CT scan report was fake. The people we used for verification gave false information. If necessary, I will testify in court.”

• SP Mohammad Hasan Chowdhury: “We have received the complaint. I will look into the matter.”

• Civil Surgeon Abhijit Sharma: “I have written to the Kishoreganj Hospital Superintendent to form a three-member committee and provide an investigation report within seven days. If the report is not satisfactory, we will conduct our own investigation.”

The Public Prosecutor (PP), Md. Jalal Uddin, stated that if any doctor issues a fraudulent medical report, there are provisions for legal action, including the cancellation of their registration, upon informing the court.
